2. Services and Pricing

Eqho AI offers generative voice AI services, including text-to-speech conversion, voice cloning, custom voice model training, and API access. Our basic subscription includes:

• 1,500 credits per month
• Unlimited Users
• Real-time reporting and analytics dashboard

Account Registration and Security

To access certain features of our website and services, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Use of Services

By using our services, you agree to:

• Not use the services to infringe upon the rights of others or violate any laws or regulations.

5. Intellectual Property

Eqho AI retains all rights, title, and interest in and to our services, including all related intellectual property rights. You retain ownership of any content you provide to us for generating voice content, and you also own the Generated Content produced using our services. However, we retain ownership of the AI models used to generate this content.

6. User Responsibility for Generated Content

6.1 You acknowledge and agree that you are solely responsible for any content you generate, create, or produce using our AI services ("User Generated Content"), including but not limited to ensuring that such content does not infringe upon any third-party intellectual property rights, including copyrights.

6.2 You represent and warrant that your User Generated Content, and the use thereof by Eqho AI and other users in accordance with these Terms and Conditions, does not and will not: (a) infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; or (b) violate any applicable law or regulation.

6.3 Eqho AI does not claim ownership of your User Generated Content. However, you grant Eqho AI a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, and distribute such content in any existing or future media, solely for the purpose of providing and improving our services.

6.4 You agree to indemnify, defend, and hold harmless Eqho AI and its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your User Generated Content or your violation of this section.

6.5 Eqho AI reserves the right, but is not obligated, to monitor and review User Generated Content. We may remove or disable access to any User Generated Content for any reason, including if we determine that such content may infringe or violate any third-party rights or any applicable law or regulation.

6.6 If you believe that any User Generated Content infringes upon your copyrights, please contact us at [[email protected]] with information specified under the Digital Millennium Copyright Act (DMCA), including a detailed description of the alleged infringement.

7. Privacy and Data Security

We collect and process certain data to provide our services. Our data collection and use practices are outlined in our Privacy Policy, which is incorporated by reference into these Terms and Conditions. We implement reasonable security measures to protect your data from unauthorized access, disclosure, alteration, and destruction.

When using the EQHO plugin for ChatGPT or other MCP clients, you must only request or share records you are authorized to access and only the information needed for the requested task. You are responsible for required notices and consents for recording, transcription, AI processing, and communications involving other people.

Do not use the plugin or MCP tools to collect, solicit, upload, or retrieve payment-card data, protected health information, government identifiers such as Social Security numbers, or authentication secrets. Do not submit biometric templates or use these tools to create biometric identifiers or voiceprints. Use the designated sign-in and billing interfaces, not chat or tool inputs, for authentication and payments. Consent does not override these restrictions. Other legally sensitive data requires strict necessity for a permitted feature, legally adequate consent, and disclosure before collection.

Tool results are shared with the connected AI provider, and requested actions may send information to communication recipients or configured integrations. Disconnecting does not undo completed actions or delete previously shared copies. See our connected-app privacy disclosure for data categories, purposes, recipients, retention, and user controls.

8. Billing and Payment

Subscription fees are billed monthly. Additional credit usage is billed based on the pricing matrix above. All fees are non-refundable unless otherwise specified or required by law. We reserve the right to change our fees upon 30 days' notice.

9. Termination

We reserve the right to suspend or terminate your access to our services at any time for any reason, including violation of these Terms and Conditions or failure to pay fees when due.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free from harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, Eqho AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.

12. Indemnification

You agree to indemnify and hold Eqho AI harmless from any claims, liabilities, damages, losses, and expenses arising out of your use of our services or violation of these Terms and Conditions.

13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the State of Utah. Any disputes arising from these terms or our services shall be resolved through binding arbitration in Salt Lake City, Utah.
